NEW JOSHUA TREE DOLLAR GENERAL COURT RULING TIGHTENS LANGUAGE

Yesterday, the group that is leading the charge against a proposed Dollar General retail store in Joshua Tree announced a legal victory on its web site. Reporter Dan Stork examined the legal document provided by the Joshua Tree Downtown Business Alliance, and says that it dots some i’s and crosses some t’s, relative to what the Court said in March of this year…
Back in March, a court told San Bernardino County and the developer of the proposed Dollar General store east of downtown Joshua Tree, that it was holding up a permit for the store, until the County came up with an Environmental Impact Report that addressed the store’s potential impact on urban decay. On October 21, the Joshua Tree Downtown Business Alliance posted on its website jtdba.org a recap of its views against the project, together with a copy of a newer court document, dated September 22. The September document repeats the March decision, with some tighter language: The County can’t do anything that favors the project, until it completes the EIR and the court accepts that report. There is also provision for the JTDBA to recover its legal costs from the county and the developer, but the amount is, as yet, unspecified. A source close to the JTDBA effort said that the County and developer have until November 28 to appeal this latest ruling.
